Privacy Policy

This Privacy Notice (together with our Data Protection Policy) sets out how Antony Gormley Studio ("Antony Gormley Studio", "we", "us") uses personal data relating to Suppliers, Customers, Collectors and Contacts ("users", "you"). Antony Gormley Studio is a data controller for the purposes of the General Data Protection Regulation 2018.

Antony Gormley Studio acts as data processor for limited information passed from third-party associate Galleries. The Sales Agreement made between these Galleries and individual Collectors outlines the type of data transferred and the purposes for its transferral.

Antony Gormley Studio upholds the rights of the data subject to information, access, rectification, erasure, the restriction of processing, data portability, the right to withdraw consent, to lodge a complaint, and to object to automated decision making and profiling.

1. INFORMATION WE MAY COLLECT ABOUT YOU

Categories of personal data:

  • data relating to Suppliers
  • data relating to Customers
  • data relating to Collectors
  • data relating to Contacts

We may collect and process the following data about you:

  • Contact information
  • Name and address
  • Bank details – if necessary for payment purposes to fulfil a contractual or statutory obligation
  • Correspondence we have with you

2. WHERE WE STORE YOUR PERSONAL DATA

Once we have received your information, we will store it in electronic and physical records maintained by us and will use strict procedures and security features to try to prevent unauthorised access.

The transmission of information via the internet is not completely secure. We cannot therefore guarantee the security of data you transmit to us by email.

The Studio will seek your explicit consent before transferring your data to a destination outside the European Economic Area ("EEA"). If such consent is granted, your data may be stored, or processed outside the EEA. This processing may be carried out by staff who operate outside the EEA who work for us or our associated third-party Galleries or Institutions, or for one of our associated Suppliers. Such staff may be engaged in, among other things, the provision of support services. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Notice.

Transactional information relating to the development of a particular work, exhibition or project may be held in the Studio's archive. The Studio may, at its own discretion grant partial access to these archives to Academics and Researchers. Such Academics and Researchers would be supervised and given restricted access to transactional or anonymised data that relates directly to a work, project or exhibition.

3. USES MADE OF THE INFORMATION WE COLLECT

We may use information we hold about you for the following purposes:

for administration and accounting;

  • to provide you with information that you have requested from us (including the publications or other communications and information);
  • to respond to queries raised by you;
  • to carry out our obligations arising from any contracts entered into between you and us;
  • to ensure compliance with our Data Protection Policy;
  • to comply with legal obligations, or for the protection and enforcement of legal rights;
  • in connection with any sale of our business or assets; and
  • for archiving, or records of provenance.

4. THE LAWFUL BASIS OF PROCESSING

Antony Gormley Studio processes data with the lawful basis of legitimate interests.

The processing of data relating to Suppliers and Customers will be to allow for the fulfilment of obligations as laid out in contracts or terms of engagement.

Data relating to Collectors will be processed for accounting purposes, and limited data may be archived for reasons of provenance. Some Collector data will be received by the Studio from partner Galleries.

Contact data will be given directly, and with consent, by the data subject. Communications with Contacts will be based upon the data subject's expression of interest in receiving such communications.

5. DATA RETENTION POLICY

Antony Gormley Studio, will in general, conform with the market standard retention policy for each category and type of data. The Studio's retention policy is therefore based on the initial purposes of processing and the necessity to hold such data.

Details relating to Suppliers and Customers will be held for the length of the terms of engagement or contractual agreement, and a subsequent six years after the completion of the contract term. The details relating to Suppliers or Customers that work with the Studio regularly or need to maintain contact with the Studio due to the ongoing care and maintenance of works, will be held for a longer period of time, determined by the demands of the work.

Data relating to Collectors will be held initially for accounting purposes, and then partially purged. Any remaining data will be minimal and archived only if deemed necessary for reasons of provenance. This retention period is based upon the mutual interests of both the data subject and the Studio and is reviewed regularly.

Information relating to Contacts will be held only for the period that the relationship with the data subject is ongoing, or that it can be argued for there to be a valid chance of future engagement.


6. MARKETING COMMUNICATIONS

The Studio may send a limited number of email and postal communications updating a select number of individuals who have expressed a desire to receive notifications of events, exhibitions and publications that may be of interest to them. If, as a recipient of such communications or information from the Studio, you no longer wish to receive information from us, you may notify us at any time in writing to the email address shown at 10 below.

7. PROFILING AND AUTOMATED DECISION MAKING

No profiling or automated decision making is undertaken by the Organisation.

8. DISCLOSURE OF YOUR INFORMATION

We may disclose your personal information to third parties in connection with the purposes outlined at 2 and 3 above, including to:

  • our associated companies;
  • academics and researchers;
  • our service providers and professional advisers;
  • prospective purchasers of our business or assets; or
  • other third parties where required or permitted by law.

We may change this privacy notice from time to time. This Privacy Notice was last updated on 25/03/18.
